Terms of Service

Welcome to theDINNER.ai. These Terms of Service ("Terms") govern your use of our mobile app and website. By using theDINNER.ai, you agree to these Terms. If you don't agree, please don't use the app.

1. Who we are

theDINNER.ai is published by Luis Oppenheimer ("we," "our," "us"). Contact: support@thedinnerai.com.

2. Your account

You must be at least 13 years old to create an account.
You're responsible for keeping your login credentials secure.
You agree to provide accurate information and to update it if it changes.
You're responsible for activity on your account.

3. Subscriptions and payments

theDINNER.ai offers a free tier and a Pro subscription tier.
Pro subscriptions are billed monthly through the App Store (iOS) or Google Play (Android) at the price shown in the app (currently $9.99/month).
New subscribers may receive a 7-day free trial. After the trial, your subscription automatically converts to a paid subscription unless you cancel at least 24 hours before trial end.
Subscriptions auto-renew at the end of each billing period unless canceled.
Refunds are handled by Apple or Google per their policies — we cannot issue direct refunds.
Cancel anytime in your App Store or Google Play subscription settings.

4. Acceptable use

You agree not to:

Use the app for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract the source code of the app.
Attempt to bypass subscription gates or rate limits.
Use automated tools (bots, scrapers) to access the app.
Transmit malware, viruses, or malicious code.
Harass, abuse, or threaten other users or our team.
Use the AI features to generate harmful, illegal, or abusive content.

We may suspend or terminate accounts that violate these rules.

5. Your content

You retain all rights to recipes, meal plans, notes, and other content you create in the app. By using the app, you grant us a limited license to store, display, and process this content solely to provide the service to you.

You're responsible for the content you create. Don't upload content that infringes someone else's rights.

6. AI-generated content

The AI Co-Pilot uses Anthropic's Claude API to generate meal suggestions, recipes, and plans. AI output may occasionally be inaccurate, incomplete, or inappropriate. Always use your judgment, especially for dietary restrictions, allergies, and food safety. We are not liable for outcomes from following AI-generated suggestions.

7. No medical or nutritional advice

theDINNER.ai is a meal-planning tool, not a medical or nutritional service. Information in the app is for general informational purposes only and is not a substitute for professional medical, dietary, or nutritional advice. Consult a qualified healthcare provider before making significant dietary changes, especially if you have allergies, medical conditions, or special dietary needs.

8. Intellectual property

The app, including its design, logos, graphics, software, and other materials (except your content), is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without written permission.

9. Third-party services

The app relies on third-party services including Anthropic (Claude AI), Supabase (backend), RevenueCat (subscriptions), Spoonacular (recipe data), and Apple/Google (payments). We are not responsible for the availability, performance, or data practices of these services. Their respective terms and privacy policies apply.

10. Termination

You can stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the service, or engage in fraud. On termination, your right to use the app ends immediately, but any provisions that by nature should survive (IP, disclaimers, limitation of liability) will survive.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the app, your content, or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States. If you are a consumer in the EU/EEA or UK, you retain any mandatory protections of your home jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll notify you in-app or by email. Continued use of the app after changes take effect constitutes your acceptance of the updated Terms.
